August 22, the decision of the European Court comes into force, according to which a moratorium on the sale of agricultural land is recognized as violating human rights. This is stated in the message of the company EasyBusiness, Ukrainska Pravda writes.

The decision was made in the framework of the so-called case “Zelenchuk and Tsitsyura v. Ukraine”. The court ruled that the state did not provide a fair balance between the general interests of society and the property rights of the applicants.

“Even today Ukrainian landowners who want to protect their property rights (limited by a moratorium) will be able to refer to their decisions the ECHR decisions,” the report said.

In accordance with the Law of Ukraine “On the implementation of decisions and application of the practice of the European Court of Human Rights”, the decision of the ECHR becomes a source of law in Ukraine, from the moment that a three-month period passes from the date of the decision.

Recall, the Cabinet first expected a bill on the circulation of agricultural land by the end of December 2016.
Instead, the Verkhovna Rada in late October extended the moratorium on the sale of agricultural land, introduced in 2002, until 2018.

However, land reform is an important condition for the cooperation program between Ukraine and the International Monetary Fund.
